5. Appointing Arbitrators for Flood Claim Reinsurance Recoveries Case Due to the Flood in 2011
The Association has been a center for pursuing the flood claims from reinsurance companies, pertaining to
the Flood in 2011. In this regard, the Association has invited those who has experience in reinsurance to be
arbitrators, having President of the Association as the appointer in accordance to the agreement of the contract.
Furthermore, the Association has coordinated with the Alternative Dispute Resolution Office, Office of the Judiciary,
to assist litigants to bring the cases into the process of dispute resolution under the Alternative Dispute Resolution
Office, Office of the Judiciary.
6. Contributing Opinions on Drafts of Insurance Commission Declarations
The Committee, together with member companies, contributed opinions on drafts of Insurance Commission
Declarations as follows:
- Guidelines for Structure, Qualification, and Best Practices of Directors of Life and Non-life Insurance
Companies;
- (Draft) Prescribed Rules, Procedures, and Conditions for Permission to Have Branch Overseas of Non-life
Insurance Companies;
- (Draft) Prescribed Rules, Procedures, and Conditions for Minimum Standards for the Risk Management of
Life/ Non-life Insurance Companies.
7. Contributing Opinions on the Draft of the National Anti-Corruption Commission Declaration on
Determination of Amount and Value of Assets in a Transaction That Need to Be Reported to the
National Anti-Corruption Commission B.E……
The Commission contributed opinions on the draft of the National Anti-Corruption Commission Declaration
on Determination of Amount and Value of Assets in a Transaction That Need to Be Reported to the National
Anti-Corruption Commission B.E……, making points that since insurance companies are financial institutions that
have to comply with anti-money laundering and combatting with financing terrorism laws that have stipulated the
companies’ duty of reporting on transactions, if there will be any other law to be enforced additionally, it should be
in line with existing laws, so that the financial institutions can set the process of transactions audit at one time, and
public organizations shall have a collaboration in exchanging information instead of demanding private sector to
perform.
8. Developing Insurance Expressway System (Complain Unit)
Office of Insurance Commission (OIC) had developed Insurance Expressway System (Complain Unit), to
increase the efficiency of public protection to be covered as stated in insurance contract conveniently, promptly,
with transparency, economically, and fair, and to increase the potential of claim management of insurance
companies. The Association appointed 5 representatives to join in the working group and the Insurance Commissioner
has issued Commandment No.40/2014 - Require Insurance Companies to Report a Group or Major Accident.
9. Revision and Amendment of Definitions, Conditions, and Exclusions of Insurance Policies
The Committee set up a Working Group of Revision and Amendment of Definitions, Conditions, and
Exclusions of Insurance Policies to revise and amend definitions, conditions and exclusions of various insurance
policies that were talking about the same things to be in uniform and consistent. Recently, it has been considered
and resolved that coverage of all types of insurance shall end at 4.30 p.m. on the expiry date, except for health
insurance and travel accident insurance. The Association has written to inform OIC since December 24, 2014.
