SPECIAL MARINE CARGO OPEN POLICY CONDITIONS
Attaching to and forming part of
Open Policy No. …………………………..
1. Automatic Cover Clause (Exports) – This policy automatically covers all shipments of
approved cargo made by the Assured, but excluding such shipments as are sold on C&F terms
or other terms which exclude Marine Insurance.
Automatic Cover Clause (Imports) – This policy automatically covers all shipments of approved
cargo made by or consigned to the Assured, but excluding such shipments as are bought on CIF
terms or other terms which include Marine Insurance.
2. Declaration Clause – The Assured warrants that during the currency of this policy he will
declare to the Insurer (on forms supplied by the Insurer) all shipment to which this policy
attached, on the date of receiving advice thereof or as soon thereafter as maybe practicable;
failure to so declare shall at the Insurer’s option to render this policy void as from the date of
such failure; Premium shall be paid to the Insurer monthly.
The Assured agrees to declare all shipments made for the Assured’s account to the following
who will supply declaration forms for this purpose upon request:
3. Negotiable Certificate Clause – The Insurer is hereby authorized by the Assured to issue
negotiable certificates to sellers upon request, making loss, if any, payable to the seller.
4. Payment of loss Clause ; Loss, if any, payable to the Assured, or order, or to proper holders
of certificates of insurance issued hereunder.
5. Conveyance Clause – Shipped or to be shipped by approved iron or steel steamers and
connecting conveyance by land or otherwise.
6. Voyage Clause – At and from any port in worldwide to any places worldwide as specified by
the Insured.
7. Term & Cancellation Clause – This policy is to be deemed continuous and to cover and attach
on all goods shipped on or after ......................................................and to continue in force thereafter until
cancelled by either party giving the other 30 days’ written notice. Such cancellation, however,
shall not prejudice any risk then pending.
If this policy cover War Risks, same may be cancelled by either party giving the other 7 days’
written notice except for shipments to or from the United States of America which may be
cancelled by either party giving the other 48 hours’ written notice. Such cancellation, however,
shall not affect any shipment on which this War Risk insurance has attached under Clause 2 of
the Institute War Clauses prior to the effective date of such notice.
If this policy covers Strikes Risks, same may be cancelled by either party giving the other 7
days’ written notice except for shipments to or from the United States if America which may be
cancelled by either party giving the other 48 hours’ written notice.
