Performance Report of the Arbitration Office
The Arbitration Office of Thai General Insurance Association was founded in 1994, due to the Association’s
awareness of the importance and benefits of using arbitration to resolve civil disputes between member
companies. Arbitration helps reduce number of cases to go to courts, save costs of insurance companies, allows
arguments to be settled more conveniently and fairly while using less time, builds good image of insurance
business to the public, and help insureds to receive claim payments faster and justifiably.
Vision:
To resolve civil disputes between member companies smoothly, quickly, as well as trustworthily and
satisfactorily for both disputing parties.
Missions:
1. Acting strictly, accurately, and justifiably, in compliance with regulations stipulated in the Thai General
Insurance Association’s Agreement on Dispute Resolution by Arbitration and other related laws.
2. Giving advice and recommendation to member companies and concerned parties about the operation
of dispute resolution.
3. Collecting arbitration awards in a form of books to facilitate member companies and concerned parties
in studying lines of the awards for new dispute resolution considerations.
4. Employing new technology in operation, data collection, and dispute record control to facilitate and
shorten time of tracking dispute records.
5. Suggesting improvements of regulations stipulated in the Thai General Insurance Association’s
Agreement on Dispute Resolution by Arbitration to make the arbitration operation more efficient.
In 2015, the Arbitration Office received 3,603 cases of disputes, an increase of 41% or 1,055 cases from
the prior year. Amount of all disputed cases in 2015 totaled approximately 207 million baht. The highest case
amount disputed was approximately 1 million baht. In 2015, the Office had settled 3,262 cases, of which 498
disputes or 15% of the total were ruled by arbitrators; 2,204 disputes or 68% of the total were compromised
in the secretariat level of the Arbitration Office; and 560 disputes or 17% of the total were withdrawn from the
arbitration. The amount of total settlements in 2015 was around 39 million baht before being settled and 34
million baht after the settlements. As of December 31, 2015, there were 2,299 cases pending; 21 cases being
under the process of withdrawal from the arbitration in relation to disputes with the Samphan Insurance Company
Limited; 2,278 cases being undertaken; 1,826 cases being under the process of arranging appointments for
compromising and filing for objection; and 452 cases being reviewed by arbitrators.
For the year 2015, the Office received fees from submissions of disputes and dispute objections for
3,320,800 baht and from appointments of arbitrators and postponements for 3,528,723 baht, making the total
fees to 6,849,523 baht, an increase of 1,069,811.79 baht from the prior year.
For the arbitration operation, from the founded day in 1994 to the end of December 2015, there were
110,322 cases of disputes filed, of which 108,023 cases or 97.92% of the total having already been settled
and 2,299 cases or 2.08% of the total being in process. Regarding the 108,023 settled cases, 23,369 cases or
21.63% of the total were ruled by arbitrators; 69,370 cases or 64.22% of the total were compromised; 15,209
cases or 14.8% of the total were withdrawn from the process; and 75 cases or 0.07% were dismissed.

in order to thank you persons who have been involved in the establishment of the Arbitration Office, strengthen
the cordial relationships with the member companies and publicize the Arbitration Office performance through
the mass media.
